Superfecta.cloud Terms of Service

IMPORTANT: THIS IS A TECHNICAL DEMO IN BETA PHASE
Superfecta.cloud ("Service," "we," "us," or "our") is a technical demonstration project operated solely for testing, experimentation, and educational purposes. The Service is provided strictly in beta and is not a production-grade, commercial, or fully supported file storage platform. By accessing or using the Service at https://www.superfecta.cloud (or any associated domains, subdomains, or applications), you acknowledge and agree that:
• This is not a finished product.
• The Service may be unstable, incomplete, or subject to sudden changes, downtime, or complete shutdown without notice.
• We make no representations or warranties of any kind regarding reliability, security, data integrity, availability, or fitness for any purpose.
• You use the Service entirely at your own risk.
1. ACCEPTANCE OF TERMS
By creating an account, uploading any file, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy (if one exists), and any additional rules or policies we may post.
2. DESCRIPTION OF THE SERVICE
Superfecta.cloud offers a quadruple-redundant US-based file storage demonstration. The Service remains a technical demonstration in beta regardless of any payment. A free tier is available, and paid subscription tiers may be offered. Any paid subscription entitles you ONLY to (a) the additional storage capacity stated for that tier and (b) the level of customer support stated for that tier. Payment does NOT purchase, guarantee, or imply any greater data durability, availability, security, integrity, backup, or fitness for any purpose than the free tier, and does NOT change the beta / technical-demonstration nature of the Service or any of the disclaimers in these Terms. The Service, including any tier, may be modified, limited, or discontinued at any time without notice or liability. Subscription fees already paid are non-refundable except where required by law.
3. BETA PHASE AND TECHNICAL DEMO DISCLAIMER
The Service is explicitly labeled and operated as a technical demo / proof-of-concept in beta. We do not guarantee continuous availability, data durability, security against unauthorized access, or compliance with any industry standards. All data stored is considered test data. Do not upload files containing sensitive, confidential, personal, or irreplaceable information.
4. NO RESPONSIBILITY FOR DATA LOSS
WE ARE NOT RESPONSIBLE FOR ANY DATA LOSS, CORRUPTION, DELETION, OR UNAUTHORIZED ACCESS, FOR ANY REASON WHATSOEVER. You are solely responsible for maintaining your own backups of all files you upload.
5. DATA RESIDENCY AND CROSS-BORDER TRANSMISSION
The Service is hosted entirely within the United States. When you upload, download, or access files, data may cross international borders depending on your location. We make no representations regarding data residency or compliance with laws of any jurisdiction outside the United States.
6. USER ACCOUNTS AND CONDUCT
You must provide accurate information when creating an account. Prohibited conduct includes uploading illegal or harmful content, attempting to disrupt the Service, or using the Service for commercial purposes. We reserve the right to delete any account or file at any time without notice.
7. INTELLECTUAL PROPERTY
You retain ownership of the files you upload. All underlying code, design, and technology of Superfecta.cloud remain our exclusive property.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" WITH NO WARRANTIES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $1.00 USD.
9. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your uploaded files, or your violation of these Terms.
10. TERMINATION
We may terminate or suspend your access at any time without notice.
11. GOVERNING LAW
These Terms are governed by the laws of the United States and the State of North Carolina. Disputes shall be resolved in Waynesville, North Carolina.
By using Superfecta.cloud, you explicitly acknowledge that this is a beta technical demonstration and that you assume all risk of data loss and any other consequences associated with the Service.
